Terms of service

These terms apply when you buy a prepaid data eSIM from Clear Roam, operated by Bearacle of 30 N Gould St Ste N, Sheridan, WY 82801, USA. By completing a purchase you accept them.
1. What you are buying
A prepaid allowance of mobile data, delivered as an eSIM profile for a specific destination or group of destinations. The plan you choose sets how much data you get, over what period, and in which countries. It is a data-only service: it does not include calls or SMS on your Clear Roam line.
We are a reseller. The underlying connectivity is provided by mobile network operators in each destination, reached through our supplier. We do not own or operate those networks.
2. Your device
You are responsible for checking, before you buy, that your phone:
- supports eSIM, and
- is not locked to a single carrier.
A phone that is not eSIM-capable, or is carrier-locked, cannot install the profile. Our install help explains how to check. If you buy without checking and the profile cannot be installed, section 6 still applies — provided you have not installed it.
3. Prices and payment
All prices are shown and charged in US dollars. The price you see at checkout is the price charged; we derive it on our servers from the plan you selected, not from anything sent by your browser.
Card payments are handled by Stripe. We never receive or store your card number. When you pay, the amount is first authorised — held by your bank, not taken. It is captured only once an eSIM has actually been issued to you. If we cannot issue one, the authorisation is released and you are not charged.
Your bank or card issuer may apply a currency conversion or foreign transaction fee. That is between you and them, and is not part of the price we quote.
4. Delivery and installation
Once payment is authorised and the profile is issued, we show you a QR code plus the SM-DP+ address and activation code it contains. Delivery is complete when those details are made available to you. You can return to them at any time under My eSIMs.
Installing the profile requires an internet connection, so do it before you travel. Each activation code can normally be installed once. If you delete the profile from your phone, you may not be able to reinstall it, and that is not a fault we can reverse.
5. Using the service
Data roaming must be switched on for the Clear Roam line once you arrive, or the plan cannot work. Plans begin according to the terms shown on the plan itself and expire at the end of their validity period, whether or not the allowance has been used. Unused data has no cash value and does not roll over.
Where a plan has a fair-use policy, it is stated on the plan before you buy — including the reduced speed that applies after the allowance, or that data stops until the allowance refreshes. We only describe a plan as "unlimited" where the reduced speed remains usable; where it does not, the plan is sold on its stated allowance instead.
You agree not to use the service:
- for anything unlawful, or in breach of the local network operator's terms;
- to send bulk unsolicited messages, or to operate a service that resells our connectivity;
- in a way that places an abnormal load on a network, including permanent use of a travel plan as a substitute for a domestic connection.
Networks may suspend service for abuse of this kind, and we may cancel a plan we reasonably believe is being used this way.
6. Refunds
- An eSIM you have not installed
- Can be refunded in full. Email info@bearacle.com with the address of your order page and we will cancel it.
- An eSIM you have installed or that has connected to a network
- Cannot be refunded. Once the profile has been activated, the data has been bought from the carrier and cannot be returned to us.
- An eSIM that does not work through our fault or our supplier's
- Is refunded, whether or not it has been installed. Tell us what happened and we will look at the provisioning record rather than take your word or ours for it.
Refunds go back to the card used for the purchase. Nothing here removes any statutory right you have as a consumer, which sits alongside these terms rather than being replaced by them.
7. What we do not promise
Mobile coverage depends on the local network, your device, and where you physically are. We publish the carriers and network generations each plan can reach, taken from network data rather than a marketing map, but we cannot guarantee coverage, a particular speed, or uninterrupted service at any given place or moment.
We do not promise the service is fit for anything safety-critical. Do not rely on it for emergency calls; a data-only eSIM cannot make them.
8. Our liability
Where we are liable to you, our total liability for any plan is limited to the amount you paid for that plan. We are not liable for indirect or consequential losses — missed bookings, lost business, or costs incurred because you had no data.
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
9. Your account
Buying requires an account, so that your eSIM and its QR code remain reachable and so refunds can be traced to a purchase. Keep access to your email secure: a sign-in code sent to your address is enough to reach your orders. You can delete your account at any time by emailing info@bearacle.com; see the privacy policy for what deletion does and does not remove.
10. Changes
We may change these terms. The version that applies to a purchase is the one published when you made it, and the date at the top of this page tells you when it last changed. Material changes will not be applied retroactively to a plan you have already bought.
11. Governing law
These terms are governed by the law of the State of Wyoming, USA, and disputes are subject to the courts of Sheridan County, Wyoming.
